Funeral & Cemetery Pre-Need Contract Checklist

What it should state. What's commonly not stated. What to ask before you sign.

You're about to sign a pre-need contract with a funeral home or cemetery. This page lists what a complete one states, the lines that are commonly not stated, and the questions worth asking before your name goes on it.

This is a reading checklist, not advice. Spend Defense doesn't tell you whether to sign — we make sure you've actually seen what's on the page, and what isn't.

What a complete pre-need contract states

  • Itemized goods and services — each item and service with its own price, not only a package total.

  • Price-locked vs. not price-locked — which items are "guaranteed" at today's price and which may cost more later.

  • Total price and payment plan — the full amount, installments, and any finance charge.

  • Where the money goes — a trust, an insurance policy, or the funeral home directly.

  • Cancellation and refund — how to cancel and how much comes back.

  • Transfer terms — what happens if you move or want a different provider.

  • Cemetery items — plot, opening and closing, vault, and marker — each included or separate.

What's commonly not stated

  • Non-locked items — cash-advance items (flowers, obituaries, certificates) are often not price-locked; the difference may fall to your family.
  • Sale or closure — what happens if the funeral home is sold or closes is rarely explained.
  • Interest and trust earnings — who keeps earnings on money held in trust is often unstated.
  • Cemetery charges — opening/closing and marker installation may be excluded from a funeral contract.

None of these gaps decide anything by themselves. They're the lines to ask about before you sign, not after.

Questions to ask before you sign

  1. “Which items are price-locked, and which could cost more later?”
  2. “Can I see the itemized price of each good and service?”
  3. “Where is my money held — a trust, insurance, or the funeral home?”
  4. “How do I cancel or transfer, and what do I get back?”
  5. “What happens if the funeral home is sold or closes?”

FAQ

How much does a prepaid funeral usually cost?

We don't price other people's services — cost depends on the goods and services chosen, the location, and cemetery charges. What you can check is whether your contract itemizes each item, says which prices are locked, and states where the money is held. If it doesn't, ask before signing.

What if something on this checklist is missing from my pre-need contract?

Ask for it in writing before you sign. A missing itemized price or trust detail isn't a verdict on the provider; it's an unknown your family may face later. Getting it stated on the page costs nothing and settles it while you can still ask.

Can Spend Defense read my actual pre-need contract?

Yes. Short contracts fit the Quick Check ($4.99, up to 10 pages); contracts with trust or insurance documents attached often go through the Document Review ($19, up to 25 pages). You'll get back what it says, what's not stated, and what to ask.
